These Terms & Conditions (“Terms”) govern all purchases, memberships, bookings, services, and participation with The Mat Collective LLC (“The Mat Collective,” “we,” “us,” or “our”), which owns and operates the fitness studio known as The Mat by Forma Haus.

By purchasing, booking, enrolling in, or participating in any class, membership, package, workshop, event, retail purchase, gift card, or other product or service offered through The Mat by Forma Haus, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. PURCHASES & PAYMENT

All prices are listed in U.S. Dollars (USD) and are subject to change at any time without notice.

Full payment is required at the time of purchase unless otherwise stated in writing by The Mat Collective LLC.

We accept approved payment methods made available at checkout.

You authorize The Mat Collective LLC to charge your selected payment method for all purchases, recurring membership charges, applicable taxes, fees, penalties, and other authorized charges.

You are responsible for maintaining current and accurate payment information at all times.

2. CLASSES, PACKAGES & MEMBERSHIPS

Class packs, memberships, promotional offers, and account credits are non-transferable and may only be used by the purchasing client unless expressly stated otherwise.

Expiration dates apply to all class packs, promotions, introductory offers, and account credits and will not be extended except where required by law.

Membership benefits may only be used by the registered member.

Unused classes, credits, or membership benefits do not carry cash value and may not be redeemed for cash.

Memberships automatically renew according to their applicable billing cycle unless canceled in accordance with these Terms.

3. CLASS RESERVATIONS, CANCELLATIONS, NO-SHOWS & LATE ARRIVALS

Clients are responsible for managing their reservations through the designated booking platform.

Class cancellations must be made at least eight (8) hours prior to the scheduled class start time.

Late cancellations will incur a $10 fee and result in the loss of the class credit.

No-shows will incur a $20 fee and result in the loss of the class credit.

Late arrivals may be denied entry at the discretion of studio staff or instructors for safety, operational, or class experience reasons and may be treated as a no-show.

The Mat Collective LLC reserves the right to modify cancellation fees and policies upon notice.

4. MEMBERSHIP CANCELLATION, AUTO-RENEWAL & COMMITMENTS

Memberships may be canceled with at least fourteen (14) days’ written notice prior to the next billing date.

By purchasing a membership, you acknowledge and agree that your membership will automatically renew at the end of each billing period unless canceled in accordance with these Terms. Recurring membership charges will automatically be billed to the payment method on file at the then-current membership rate.

By enrolling in a membership, you authorize recurring charges to your payment method until your membership is properly canceled in accordance with these Terms.

Memberships must complete their original commitment term.

If proper cancellation notice is not provided, the membership will automatically renew according to its billing cycle and applicable commitment structure.

Early cancellation prior to completion of the original commitment term will incur a $200 early cancellation fee.

Membership freezes are permitted only in cases of verified medical necessity and require submission of a physician’s note or other documentation acceptable to The Mat Collective LLC.

Members are eligible for a maximum of one (1) approved membership freeze per membership commitment term.

Approved membership freezes will be subject to a $50 monthly freeze fee and may not exceed three (3) consecutive months.

During an approved freeze period, membership benefits, class access, and booking privileges will be suspended. Membership billing will be adjusted to the applicable freeze rate.

At the conclusion of the approved freeze period, the membership will automatically reactivate and regular membership billing will resume using the payment method on file.

The duration of any approved freeze will extend the member’s commitment term by the same amount of time as the freeze period.

Freeze requests must be submitted in writing and approved by The Mat Collective LLC prior to the requested freeze start date. Retroactive freezes will not be granted.

No other pauses, freezes, suspensions, transfers, or holds will be permitted except at the sole discretion of The Mat Collective LLC.

Cancellation requests must be submitted in writing to hello@matpilatesstudio.com and are not considered effective until confirmed in writing by The Mat Collective LLC.

Declined, expired, or failed payment methods do not constitute cancellation of a membership.

The Mat Collective LLC reserves the right to suspend booking privileges, restrict account access, pursue collection efforts, or assess applicable fees for unpaid balances.

All membership payments are non-refundable except as required by law.

5. REFUNDS, CREDITS & EXCHANGES

All purchases are final sale.

No refunds, credits, exchanges, or transfers will be provided for classes, memberships, packages, workshops, events, or services except as required by applicable law.

All retail merchandise is final sale and is non-refundable and non-exchangeable.

Gift cards are non-refundable, non-transferable, have no cash value, and may not be redeemed for cash except where required by law.

In the event The Mat Collective LLC is unable to provide services due to circumstances beyond its reasonable control, The Mat Collective LLC may, at its sole discretion and subject to applicable law, provide credits, extensions, prorated adjustments, alternative services, or other remedies.

6. GIFT CARDS & PROMOTIONAL OFFERS

Gift cards may only be redeemed toward eligible products and services offered through The Mat by Forma Haus.

Promotional offers, discounts, introductory packages, and incentives may not be combined unless expressly stated otherwise.

Promotions may be modified, suspended, or discontinued at any time, subject to applicable law.

Promotions and discounts have no cash value and may expire.

7. HEALTH & SAFETY ACKNOWLEDGMENT

You acknowledge that participation in fitness activities, exercise classes, and use of fitness equipment involves inherent risks, including but not limited to injury, illness, disability, property damage, or death.

You represent that you are physically capable of participating in the classes and activities you choose to attend through The Mat by Forma Haus.

You agree to consult a physician before participating if you have any medical concerns, conditions, injuries, or limitations.

You agree to immediately discontinue participation and notify staff if you experience pain, dizziness, discomfort, or any medical issue during participation.

8. ASSUMPTION OF RISK & LIABILITY WAIVER

You voluntarily assume all risks associated with participation in classes, events, workshops, use of facilities, and use of equipment.

To the fullest extent permitted by applicable law, you release, waive, discharge, and hold harmless The Mat Collective LLC, and its owners, members, officers, managers, employees, instructors, independent contractors, agents, successors, affiliates, and representatives from claims, liabilities, damages, losses, costs, expenses, or causes of action arising out of or relating to participation in activities or use of services, facilities, or equipment, except to the extent such release or waiver is prohibited by applicable law.

Participation may require execution of a separate Liability Waiver and Release Agreement, which is incorporated into these Terms by reference.

9. STUDIO POLICIES & CLIENT CONDUCT

Clients are expected to follow all studio policies, posted rules, instructor guidance, and safety procedures.

Disruptive, abusive, threatening, inappropriate, unsafe, or unlawful conduct may result in removal from class, suspension of privileges, termination of membership, or refusal of future service without refund, subject to applicable law.

The Mat Collective LLC reserves the right to refuse or terminate service for violations of studio policies, safety concerns, operational reasons, or other lawful grounds.

10. CHANGES TO SCHEDULE, INSTRUCTORS & SERVICES

Class schedules, instructors, formats, amenities, services, operating hours, and offerings are subject to change at any time.

The Mat Collective LLC does not guarantee the availability of any specific instructor, class format, service, or schedule.

To the fullest extent permitted by applicable law, The Mat Collective LLC shall not be liable for cancellations, substitutions, delays, interruptions, or schedule changes.

11. FORCE MAJEURE

The Mat Collective LLC shall not be liable for any delay, interruption, modification, reduction, suspension, or failure to perform due to causes beyond its reasonable control, including but not limited to natural disasters, severe weather, fire, flood, earthquake, pandemic, epidemic, public health emergency, government action, labor disputes, utility outages, equipment failures, civil unrest, acts of terrorism, supply chain disruptions, or other force majeure events.

12. INTELLECTUAL PROPERTY

All trademarks, logos, branding, class concepts, videos, photographs, graphics, website content, materials, and other intellectual property associated with The Mat by Forma Haus are owned by or licensed to The Mat Collective LLC or their respective owners, as applicable.

No protected content may be copied, reproduced, distributed, recorded, published, or otherwise used without prior written permission from the applicable rights holder.

13. PRIVACY

Personal information collected through purchases, bookings, memberships, communications, or participation is handled in accordance with our Privacy Policy.

Our Privacy Policy explains how we collect, use, disclose, store, and protect personal information and is incorporated into these Terms by reference.

13A. SMS MESSAGING TERMS

1. Program Description

By opting in, you agree to receive recurring automated text messages from The Mat Collective LLC, operator of The Mat by Forma Haus (“we,” “us,” or “our”), at the mobile number you provided.

Messages may include class and appointment reminders, booking confirmations, waitlist notifications, membership and account updates, billing notifications, studio announcements, promotional offers, marketing communications, customer support follow-ups, and other information related to our services.

Consent to receive these messages is not a condition of any purchase.

2. Message Frequency

You may receive up to ten (10) messages per month. Message frequency may vary depending on your account activity, bookings, memberships, preferences, and interactions with us.

3. Message and Data Rates

Message and data rates may apply. Charges are billed by and payable to your mobile service provider. Please contact your wireless carrier for details about your messaging and data plan.

4. How to Opt Out and Get Help

You can unsubscribe from the SMS service at any time by replying STOP to any message we send you.

After you send STOP, you will receive a one-time confirmation message, and no further SMS messages will be sent unless you subsequently opt in again.

If you want to rejoin, you can sign up again using the original opt-in method or reply START, if available.

5. Carrier Liability Disclaimer

Carriers are not liable for any delayed or undelivered messages.

6. SMS Privacy

Information collected through our SMS program is subject to our Privacy Policy.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes.

All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

14. PHOTOGRAPHY & MEDIA

The Mat Collective LLC may photograph, record, livestream, or otherwise capture images, video, or audio within the studio and during classes, events, and activities.

Any use of a client’s identifiable likeness, image, voice, name, or appearance for advertising or promotional purposes will be handled in accordance with applicable law and any applicable consent or release.

Clients who do not wish to appear in photography or recordings should notify studio staff before participating.

15. MINOR PARTICIPANTS

Participants under eighteen (18) years of age may only participate with the consent of a parent or legal guardian where required and must have all required agreements, waivers, and releases executed by a parent or legal guardian.

16. ELECTRONIC CONSENT & AGREEMENT

By creating an account, making a purchase, booking a class, enrolling in a membership, checking a box indicating acceptance, signing electronically, or otherwise using services offered through The Mat by Forma Haus, you acknowledge and agree that:

(a) You have read, understood, and agree to these Terms & Conditions and any applicable Liability Waiver and Release Agreement, Privacy Policy, membership terms, and studio policies.

(b) Your electronic acceptance constitutes your legal signature and has the same force and effect as a handwritten signature to the extent permitted by applicable law.

(c) You consent to receive communications electronically, including billing notices, membership notices, account updates, and policy changes, subject to applicable law and your communication preferences.

(d) Electronic records maintained by The Mat Collective LLC may be maintained and used as business records to the fullest extent permitted by applicable law.

17. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.

To the extent permitted by applicable law, any dispute arising out of or relating to these Terms, our services, or participation shall be resolved in the appropriate courts located in Ventura County, California.

18. AMENDMENTS

The Mat Collective LLC reserves the right to update or modify these Terms from time to time.

Material changes will be posted through our website, booking platform, or other appropriate means and will become effective as stated in the updated Terms.

Continued purchases, bookings, memberships, or participation following the effective date of revised Terms constitutes acceptance of the revised Terms to the extent permitted by applicable law.
